Zego Good Driver Giveaway competition: Terms & Conditions

1. Who is running the Competition?
1. The Promoter of the Competition is Extracover Limited trading as Zego (Zego).

2. What is the Competition?
2.1 The competition will run from 29 March 2022 to 31 May 2022. Each week the driver with the top driver score will win a £50 voucher to be spent at Amazon, Sainsbury’s, Halfords, John Lewis & Partners or Deliveroo (the Voucher). The rules that apply to this are set out in more detail at paragraph 5 below; and

2.2 By taking part in the competition, you could win an electric vehicle. The winner of the electric vehicle will be randomly selected at the end of the competition. There is only one electric vehicle which can be won at the end of the competition. The rules that apply to this are set out in more detail at paragraph 6 below.

3. Who can take part in the competition?
3.1 The competition is open to all residents of the United Kingdom (England, Scotland, Wales and Northern Ireland) who:
a) hold an active and valid Private Hire Zego Sense insurance policy;
b) hold a valid UK driving licence;
c) are over the age of 21;
d) are using the Zego Sense App to generate a driver score on an ongoing and continuous basis from the date that they enter the competition until at least 23.59 on 31 May 2022.

3.2 The competition is not open to directors, officers, agents, contractors or employees of Zego, Zego’s affiliated or associated entities or divisions, advertising and promotional agencies or members of those individuals’ family members who are living in the same household.

4. How do I enter the competition?
4.1 To enter the competition, you must satisfy the eligibility criteria at paragraph 3 above and complete the entry form using either: (a) the following link: https://cloud.zego-uk.com/ev-giveaway-2022; or (b) the link set out in any email you received from Zego about this competition.

4.2 You will need to provide your email address and select a username for the competition. Your username will be shown on Zego’s public driver score leaderboard along with your driver score, which can be viewed by the public on the following link: https://cloud.zego-uk.com/ev-giveaway-2022-leaderboard

4.3 To enter the competition, you will need to confirm that you have read and understood these terms and conditions, which include featuring on Zego’s public leaderboard and for marketing purposes.

4.4 Eligible drivers can enter the competition from 13.00 on 29 March 2022.

4.5 The competition will close to new entrants at 23.59 on 31 May 2022 (the Closing Date). The competition will end at 23.59 on 31 May 2022.

4.6 Competition entries received after 23.59 on 31 May 2022 will not be included in the competition.

4.7 By entering into this competition you confirm that you are eligible to do so and eligible to claim the prize. Zego may require you to provide proof that you are eligible to enter the competition.

5. How can I win a Voucher and what additional conditions apply to this?
5.1 You must use the Zego Sense App for up to 14 days to generate a driver score. You can review your driver score using the dashboard in the Zego Sense App.

5.2 The driver with the best driver score at the end of each working week (i.e. each Friday) will win a £50.00 Voucher, starting 8th April. The Voucher winners will be announced on the dates set out in the table below.

5.3 The driver score will be based on data collected in the 14 days immediately preceding the end of each week during the competition. The score at the end of each working week will be used to determine the best driver score. If more than one driver achieves the best driver score for the relevant week, the winner will be randomly selected using impartial software.

6. How can I win the electric vehicle and what additional conditions apply to this?
6.1 The winner of the prize draw for the electric vehicle will be able to choose an electric vehicle up to the value of £35,000.00 inclusive of all fees, including but not limited to dealership fees, delivery fees, vehicle specifications and cost of installing a home charging point for the vehicle. No cash alternative will be provided, even if the selected vehicle is less than £35,000.00.

6.2 The prize draws will be carried out using impartial software designed to fairly select the winner at random. The prize draw will take place at the end of the competition. Drivers that withdraw from the competition before the competition ends will not qualify for a chance to win the electric vehicle. The prize draw will take place between 1 June 2022 and 7 June 2022.

6.3 It is the responsibility of the winner of the electric vehicle prize draw to ensure that they hold a valid UK driving licence and any other necessary documentation required to establish legal ownership and use of the vehicle.

6.4 There is only one prize draw which is set to take place at the end of the competition, with only one prize for one driver.

6.5 The winner of the electric vehicle prize draw acknowledges that there may be natural delays in the process of ordering and delivering the electric vehicle, which are outside of Zego’s control.

6.7 The odds of you winning the electric vehicle will vary depending on the number of eligible competition entries.

7. Will other drivers be able to see how I am doing?
7.1 The top 20 driver scores will be shown on a dashboard at zego.com/good-driver-giveaway from 8th April, so you will be able to see how you compare to others. You will be able to create and specify a username in the entry form which will be shown on the leaderboard rather than your name.

8. If I win, how do I claim my prize?
8.1 If you are a winner of a prize, you will be contacted by Zego on the email address associated with your competition entry within 14 days of winning the prize. In order to claim the prize you must respond to this within 14 days of receipt, proving your eligibility. You must provide any additional information required for the purposes of identification, checking your eligibility to win the competition and verification and delivery of the prize. Zego will make two attempts to contact you. If you do not respond after the second contact attempt, Zego reserves the right to refuse to award you the relevant prize and instead award it to an alternative winner subject to the requirements of these terms and conditions.

8.2 In relation to prizes consisting of Vouchers, Zego will arrange for these to be sent to the winner within 28 days, provided the winner has sent Zego all of the information that Zego needs to process the prize as set out in clause 8.1 above. If, for whatever reason, the prize is not delivered as arranged, the winner must notify Zego of the delivery failure without delay.

8.3 All prizes issued are expressly subject to any applicable terms and conditions or requirements of use which accompany the prize (including, but not limited to, a validity period for any Vouchers issued).

8.4 The prize may not be claimed by a third party on your behalf unless otherwise agreed with Zego.

8.5 Zego does not accept any responsibility for factors outside of its control which result in you not being able to take up the prize. Any prizes sent to you via email or post are at your risk, and Zego cannot be held responsible for any prizes not received by you

9 General Terms and Conditions
9.1 Zego will not accept:
9.1.1 responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical fault or malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
9.1.2 proof of transmission as proof of receipt of entry to the competition.

9.2 By entering the competition, you are agreeing to be bound by these terms and conditions.

9.3 Unless otherwise stated by Zego, entries on behalf of another person will not be accepted and joint submissions are not allowed.

9.4 Zego reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.

9.5 Prizes are subject to availability and in the event the selected prize is unavailable Zego has the right to substitute the prize (either the eclectic vehicle or the Voucher, whichever is applicable) with an alternative prize of equal or greater value. Unless otherwise agreed, there are no cash alternatives available for any of the prizes.

9.6 Zego excludes all liability for delays outside of its immediate control. In the event the order or delivery of any prize is delayed by an event outside of Zego’s control (including, but not limited to, delay as a result of a third party’s act, omission or negligence) Zego will contact the winner as soon as reasonably possible with reasons for the delay and, so far as reasonably possible keep the winner informed of any relevant updates.

9.7 The prize is not negotiable, refundable or transferable.

9.8 The decision of Zego is final and no correspondence or discussion will be entered into.

9.9 Zego must either publish or make available information that indicates that a valid award takes place. To comply with this obligation Zego will send the surname and country of major prize winners and, if applicable copies of their winning entries, to anyone who emails marketing@zego.com within one month after the competition ends.

9.10 If you object to the use of your surname, county and winning entry being published or made available please contact Zego at marketing@zego.com. In such circumstances, Zego must still provide the information and winning entry to the Advertising Standards Authority on request.

9.11 If there is any reason to believe that there has been a breach of these terms and conditions, Zego may, at its sole discretion, reserve the right to exclude you from participating in the competition.
Zego reserves the right to hold void, suspend, cancel or amend the competition where it becomes necessary to do so.

9.12 These terms and conditions shall be governed by English law and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

10. Liability of Zego
10.1 Insofar as is permitted by law, Zego, its agents and distributors will not in any circumstances be responsible or liable to compensate the winner or to accept any liability for loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Zego, its agents or distributors or that of their employees. Your statutory rights are not affected.

10.2 Zego retains the right to withhold any prize, or to suspend, cancel, or modify the competition, without liability, if, in its view, the competition has been affected by any instance of tampering, fraud, technical issues, ‘brute force’ methods, use of alias identities, or any other issues or causes beyond the control of Zego and/or which compromise the validity of the competition. Zego also retains the right, in its sole discretion, to invalidate and/or exclude any entries which it deems to be ineligible, invalid, compromised by any of the issues or causes identified above, or otherwise non-compliant with these terms and conditions or the spirit of the competition.

11. Ownership of competition entries and Intellectual Property Rights
11.1 All competition entries and any accompanying material submitted to Zego will become the property of Zego on receipt and will not be returned unless required in accordance with clause 12.

11.2 By submitting your competition entry and accompanying material you agree to:
11.2.1 assign to Zego all your intellectual property rights with full title guarantee; and
11.2.2 waive all moral rights;
in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world. For the avoidance of doubt, this clause extends to photographs taken of the competition winners.

11.3 By entering into the competition you agree to grant Zego a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

12. Data Protection and publicity
12.1 Zego will only process your personal information as set out in the Zego Privacy Notice (accessible at https://www.zego.com/privacy/). See also paragraphs 6.3 and 6.4 of the privacy notice.

12.2 By opting into a competition you agree to Zego using your Personal Data to:
12.2.1 administer your participation in the competition and as otherwise set out in the Zego Privacy Policy; and
12.2.2 if you are a winner of any competition prize, use your personal data and any photographs or images taken of you for promotional purposes.
